Chapter 6 - THE TRANSFER BEFORE THE DIVORCE
The transfer documents existed.
Bennett Guest Systems moved from the marital holding company into a subsidiary controlled by Richard's family trust. The consideration was one dollar plus assumption of development liabilities. The zero-value disclosure described the old entity after its valuable contracts and code licenses had been moved.
Richard had not simply undervalued an asset. He had presented Claire with the empty shell.
Martin's testimony was self-interested. He had approved the transaction, signed the misleading schedule, and received a bonus after the software sale. He sought immunity only when Hale Ridge's audit threatened to expose him.
Naomi corroborated his account with timestamps, board consents, and bank records. Claire's email about the pilot proved she knew the project might have value; it did not prove she knew its assets had been transferred secretly.
The family court reopened the property judgment for fraud and reserved the final remedy.
Richard faced civil sanctions and a criminal referral for false financial statements. Prosecutors did not charge him immediately. Complex valuations and attorney involvement required proof of intent beyond Martin's word.
His restructuring position weakened, but he remained strategic. He agreed to resign as CEO, surrender the management-fee company, and contribute assets if creditors allowed the family trust to retain twenty percent of the reorganized hotels.
Employee representatives supported part of the deal because it preserved more jobs than liquidation.
Claire surprised Richard by not opposing it.
“This company is not a punishment instrument,” she told the family court. “Employees should not lose work so I can watch him lose everything.”
Alexander remained recused. Privately, Claire asked whether he wished he could vote.
“Every day,” he said.
“And what would you vote?”
“That is why I cannot answer you.”
Their marriage felt the strain. Claire worried strangers would believe she had traded one powerful husband for a more powerful one. Alexander sometimes treated silence as integrity when she needed ordinary reassurance.
They began couples counseling before resentment could become their private language.
Then Richard was charged with misdemeanor assault for the hotel incident. He offered Claire a public apology and payment for damages if she supported dismissal.
The apology said muddy water had “accidentally splashed” during an emotional encounter.
Claire returned it unsigned.
