Chapter 3 - THE PLAN ELENA ONCE ACCEPTED
Six months before her death, Elena wanted to sell the house.
Bennett House was a twenty-room estate outside Charlottesville held in trust for Sofia, Camila, and Luna. Its roof leaked. Property taxes and staff costs consumed nearly a million dollars a year. Elena’s treatment bills had exhausted liquid savings.
The trust allowed a sale only if no beneficiary child used the property as a primary residence or if a court found sale necessary for their welfare.
Hollow Creek Academy appeared to solve both problems. The girls would receive grief counseling and schooling. The house would become legally vacant. Sale proceeds would enter their trust.
Elena signed the letter of intent before she discovered Valeria’s consulting fee.
She contacted Hollow Creek during a period when pain and fear made every future look impossible.
“Why didn’t she revoke the documents?” the judge asked.
She had tried.
My attorney produced a later email instructing Marco to cancel both plans. Marco called it an unsent draft. Server records showed it remained in Elena’s outbox because the home network failed that night. She never resent it.
The recorder proved she later confronted him. It did not automatically revoke a signed letter or remove his parental rights.
An audio examiner authenticated the device. Elena had been present for the conversation, making the recording lawful under Virginia’s one-party consent rule. No splice altered the words played at the wedding.
Marco’s lawyers shifted from “fake” to “misunderstood.” Hollow Creek was licensed. The developer’s offer exceeded two independent appraisals. Valeria’s fee, they said, compensated her for arranging a complicated transaction.
The judge extended the relocation freeze for ten days and appointed a guardian ad litem to investigate. The girls remained with Marco under the law’s preference for a surviving parent, but he could not take them out of state, enroll them residentially, or sell the house.
I received supervised visits.
Luna clung to my dress and asked why Daddy married before Mommy’s flowers died.
I had no answer that belonged in a five-year-old’s mouth.
Sofia blamed herself for not listening to the recorder sooner. I told her the secret should never have been placed on a child. Elena had acted from fear, but fear did not make every choice fair.
Then the estate lawyer produced a trust amendment Elena signed forty-eight hours before she died.
It removed Marco as property trustee if he married anyone holding a financial interest in a Bennett House transaction before an independent audit ended.
His marriage to Valeria triggered the clause.
Marco challenged Elena’s capacity.

In it, Elena looked into the camera and could not remember Sofia’s name.
