Chapter 3 - THE FIRST-CHILD CLAUSE
Naomi Chen arrived before sunrise.
Claire’s lawyer read the Walsh family trust and immediately stopped smiling.
Derek’s grandfather created the structure thirty years earlier.
Each family branch received a protected asset pool.
The first biological child in the branch received a controlling beneficial interest at birth or formal recognition, subject to trustee administration.
Claire’s son had been registered that morning.
If Derek was named managing parent, he would temporarily control voting instructions tied to nearly six million dollars in family assets.
Noah complicated everything.
Naomi pointed to the key phrase.
First biological child recognized under law.
Ambiguous.
Did “first” refer to birth order?
Or legal recognition order?
Patricia’s lawyers clearly planned to argue recognition order.
Noah was born first.
Claire’s son was recognized first.
Derek wanted the second interpretation.
Claire looked at the fifty-thousand-dollar demand.
“He needed me to sign this today.”
“Yes.”
“Why the money?”
“It may establish consideration. Makes the management agreement harder to attack as informal.”
Claire stared.
“He was invoicing me for legal control.”
Naomi nodded.
Then she found something else.
Walsh Child Administration LLC.
Created five months earlier.
Owners:
Derek, seventy percent.
Patricia, thirty percent.
Projected annual trustee and administration fees:
Two hundred forty thousand dollars.
Claire laughed once.
“So fifty thousand was nothing.”
“It was the door.”
Then Derek filed first.
Emergency petition asking the family court to recognize Claire’s newborn son as first recognized issue and confirm Derek’s management authority.
Fast.
Prepared.
Emily’s lawyer filed a competing paternity action for Noah.
The hospital became a legal battlefield before Claire had even been discharged.
Then Derek went public privately.
He sent family members a statement saying Emily was an unstable woman trying to extort him after a brief relationship during a separation from Claire.
Claire froze at that part.
Because she and Derek had separated for three months.
It was real.
Then he attached messages from Claire:
If you cheat on me again, I will take every cent and every Walsh share you think you control.
Also real.
Naomi looked at her.
“He’ll say you brought Emily here to destroy him.”
“I brought her because she emailed me.”
“Can you prove that?”
“Yes.”
Good.
Then Emily’s attorney called.
There was a problem.
Emily had once texted Derek:
If you don’t help with Noah’s bills, I’ll tell your wife everything.
Derek was calling it blackmail.
The clean victim story was already gone.
Then Naomi asked Claire:
“Do you want Noah recognized?”
Claire looked at her newborn son.
The question hurt more than she expected.
