Chapter 11 - THE CASES

Prosecutors did not charge both parents identically.

Diane faced:

child endangerment,

unlawful confinement,

reckless manslaughter,

and falsification related to school records.

Michael faced:

child endangerment,

reckless failure to act,

and related charges.

No one alleged intentional murder.

That distinction mattered.

The state’s theory:

Diane created and maintained the dangerous confinement.

Michael knew enough to intervene and repeatedly failed.

Diane’s defense:

She intended discipline, not harm.

She believed Emily had water.

She misunderstood silence as stubbornness.

Michael’s defense:

He relied on Diane as primary caregiver during the punishment.

He did not know water was unavailable until Sunday.

The Thursday text hurt him.

He knew there was at least a question.

He did nothing.

The case became less about one evil act than cumulative disregard.

One detail from Monday night became important because it showed the confinement had not begun as a seven-day sentence.

Michael texted Diane:

One night. Tomorrow she apologizes, we reset.

Diane replied:

Fine.

That mattered.

There was no original plan to keep Emily locked up for a week.

The punishment expanded.

Tuesday became Wednesday because Emily did not apologize.

Wednesday became Thursday because Diane thought opening the door after resistance would reward resistance.

By Friday the original reason barely mattered.

The discipline had developed its own logic.

The longer it lasted, the harder Diane found it to stop without feeling defeated.

A family therapist later described that pattern:

commitment escalation.

Adults often defend a bad decision more strongly after investing time and authority in it.

Opening the door on day five would have required Diane to admit the punishment itself had become the problem.

She preferred to believe Emily was still the problem.

Michael did something similar.

Every day he failed to intervene made intervention the next day feel like admitting he had been wrong yesterday.

Delay protected pride.

Until there was nothing left to protect.

Doors.

Valves.

Trays.

Texts.

Silence.
