Chapter 2 - NOT PRISON

Sarah hated the word:

technicality.

That was what every explanation sounded like.

Adult prison.

Juvenile detention.

Secure placement.

Residential treatment.

Probation.

Disposition.

Different labels.

Emma was still dead.

At the next hearing, Judge Hale explained more carefully.

Tyler had been ordered into secure juvenile detention pending full disposition.

Jason into a locked assessment program because of his age, role, and prior history.

Neither was simply released.

Sarah said:

“Then why did you say no prison?”

“Because defense counsel asked for transfer to adult court and adult incarceration was part of that argument.”

Sarah stared.

“So they still get locked up?”

“Yes.”

“For how long?”

“That has not been decided.”

The answer did not comfort her.

Then prosecutors outlined the initial evidence.

Tyler and Jason had been bullying Emma’s older cousin, Mason, for weeks.

Emma happened to be with Mason at the lake club that day.

Mason had gone inside to buy drinks.

The boys saw Emma alone.

One witness heard Tyler say:

“Let’s scare the little kid.”

Jason replied:

“She can swim, right?”

No one knew.

Emma could barely swim.

Sarah had been teaching her.

Then a phone extraction recovered messages from fifteen minutes before the shove.

Jason:

Bet she cries if we push her.

Tyler:

Do it together.

Jason:

Not hard.

Tyler:

Lol.

Sarah read the messages.

Not hard.

The phrase made her sick.

They had not planned to kill Emma.

They had planned to terrify her.

That distinction mattered legally.

To Sarah, it almost made it worse.

They knew there was a risk.

They simply believed the risk belonged to someone else.

Then Detective Laura Chen called Sarah.

“We found prior complaints involving the boys.”

Sarah froze.
