Chapter 12 - THE CASE DOES NOT NEED COLONEL MERCER'S FISTS

Prosecutors built the case around:

unlawful confinement,

domestic violence,

coercion,

document fraud,

evidence manipulation,

and attempted financial exploitation.

The injury evidence was documented medically.

No need for Richard to describe it publicly.

Daniel’s defense attacked Emily’s credibility.

Therapy history.

Anxiety.

Marital conflict.

One text:

I feel like I’m losing my mind.

Emily explained:

“I meant living with him made me doubt myself.”

Then Daniel’s lawyer played an audio clip.

Emily screaming:

“I hate you! I hope you lose everything!”

Real.

During confinement.

The full audio contained Daniel saying first:

“Sign it and this ends.”

Context.

Again.

Then Richard testified.

Defense expected rage.

They asked about his Army career.

Firearms.

Temper.

The old contractor threat.

Richard admitted all.

Then:

“Did you intend to hurt Daniel after seeing your daughter?”

“Yes.”

Court went still.

His attorney looked alarmed.

Richard continued:

“For several seconds, yes.”

“Did you?”

“No.”

“Why not?”

“My daughter asked me not to become evidence for him.”

That answer mattered.

He did not pretend to be emotionally pure.

He chose restraint.

After testimony, Richard sat alone in a courthouse stairwell.

Alan found him.

“You did fine.”

Richard laughed bitterly.

“I admitted I wanted to break his neck.”

“You admitted what was true.”

Richard looked down.

“I spent my career teaching young officers that anger narrows vision.”

“And?”

“I forgot the lesson the second it was my kid.”

Alan sat beside him.

“That’s why training exists. Not because emotion disappears.”

Richard nodded slowly.

Emily had needed a father more than a colonel.
