Chapter 9 - THE WOMAN WHO REPLACED THE PEN
Lorraine eventually admitted swapping the pens.
Not why at first.
She said she found Claire’s recording device and became afraid Claire would “misrepresent private family conversations.”
Then prosecutors showed the matching replacement pen purchased that morning.
Lorraine had bought two.
Not after the crash.
Before.
That changed everything.
Why buy a duplicate recording pen before Daniel hit Elliot?
Lorraine answered:
“Because Daniel told me Claire records arguments.”
True.
But timing remained strange.
Receipt:
9:14 a.m.
Crash:
10:52 p.m.
So Lorraine had planned to neutralize Claire’s recordings before any crash occurred.
Why?
Because that night Daniel planned to confront Elliot.
And Lorraine feared Daniel might come home angry and talk.
She knew a confrontation was coming.
Not necessarily a collision.
But enough.
Then one text from Lorraine to Daniel at 8:40 p.m.:
IF YOU TALK TO CRANE TONIGHT, DO NOT COME HOME RUNNING YOUR MOUTH IN FRONT OF HER.
Daniel:
She won’t hear anything.
Lorraine:
She records.
Daniel:
I know.
There.
The duplicate pen was purchased as insurance against Claire.
Before the crime.
That made the false-confession scheme feel less improvised.
Then prosecutors found a draft note on Lorraine's phone from earlier that day:
IF D GETS INTO TROUBLE TONIGHT:
1. KEEP CLAIRE CALM
2. CONTROL PHONE
3. NO RECORDINGS
4. CALL MARTIN
Martin was Daniel's longtime attorney.
The note did not mention a crash.
It suggested Lorraine expected confrontation with Elliot to create danger.
Her lawyer argued:
she knew Daniel was angry,
she feared a shouting match,
she prepared like any cautious mother.
But the phrase NO RECORDINGS sat there.
Pre-crash.
Pre-confession.
Pre-swap.
Claire stared.
Lorraine had not invented evidence control after disaster.
