Chapter 7 - DANIEL’S COUNTERATTACK
Daniel filed first.
That surprised Elena.
Petition for temporary enforcement of the postnup’s protective-management clause.
He alleged:
Elena showed severe emotional instability.
She had become unable to manage household affairs.
She recorded family conversations obsessively.
She created a hostile home environment.
She had threatened to expel Vanessa without notice.
Her mother’s illness had caused “significant psychological strain.”
The filing was insulting.
Also strategic.
Maya looked impressed in the worst way.
“He’s trying to create the exact record he talked about.”
Elena stared.
“Can he win?”
“Not on what he has.”
“But?”
“But he doesn’t need to win immediately if delay helps his lender story.”
Daniel also produced messages from Elena.
I can’t do this anymore.
I’m exhausted.
I want everyone out.
I feel like I’m losing my mind.
All real.
Sent during the worst months of caring for her mother.
Maya said:
“Context saves us.”
Then she smiled slightly.
“And the recording helps.”
Daniel’s attorney tried to exclude it.
State law allowed one-party consent in the circumstances Elena recorded.
The judge permitted it for limited purposes.
Then Daniel’s voice filled the courtroom.
Once Elena breaks…
The room changed.
Not because the recording proved every financial allegation.
Because it directly contradicted his claim that her instability developed naturally.
He had discussed producing it.
The petition failed.
