The hardest hearing was not criminal.
It was probate.
Jason petitioned to remove Margaret as trustee, claiming age-related impairment.
Even after the intersection.
Even after the video.
His lawyer argued Margaret’s memory problems had contributed to family conflict and poor financial decisions.
Margaret sat beside her attorney and listened to her son describe her as confused.
Fragile.
Dependent.
He cited:
missed appointments,
a duplicate utility payment,
a forgotten grocery list,
and one incident where she left the stove on.
Ordinary aging mistakes arranged like an indictment.
Then Margaret’s physician testified.
No dementia.
No major cognitive impairment.
Independent neuropsychological testing showed normal decision-making capacity for her age.
The court denied Jason’s petition.
Then Margaret made her own request.
She asked to resign as sole trustee voluntarily.
Jason smiled for one second.
Too soon.
Margaret continued.
She nominated an independent corporate trustee.
Not Emily.
Not Daniel.
Not herself.
A professional fiduciary.
Jason’s smile vanished.
Margaret looked directly at him.
“You spent years telling me I was too emotional to control money.”
Her voice shook.
“So I chose someone none of us can manipulate.”
