Chapter 12 - THE PLEAS

Frank took a plea first.

Securities-related fraud theories were complicated, but bank fraud, false receivables, and misrepresentation were stronger.

He admitted:

using family funds for undisclosed trading,

providing misleading performance information,

and participating in false collateral documents.

Linda faced narrower exposure.

She had received funds and knew enough about the scheme, but evidence did not show she created forged loan documents.

Her plea involved:

conspiracy-related financial conduct,

benefiting from misappropriated funds,

and obstruction after she deleted messages following Dean’s arrest.

Dean faced the most.

Forgery.

Bank fraud.

Identity misuse.

Domestic violence.

Financial coercion.

False business filings.

Then he tried one last argument.

Claire benefited from mortgage payments made through the LLC.

True.

Household bills were paid partly from the same system.

His attorney argued:

you cannot call every dollar stolen when some supported the marriage.

Also true.

The prosecution narrowed.

Not every transfer criminal.

Not every payment fraudulent.

But signatures were still unauthorized.

Loans still obtained using Claire’s identity.

That precision mattered.

Then Dean accepted a plea.

The plea did not require him to admit he had planned to assault Claire.

Evidence did not prove that.

It did require him to admit:

he used force during the confrontation,

he knew Claire had not signed the guaranties,

he caused filings to be submitted under her name,

and he concealed the financial structure from her after she began asking questions.

Claire preferred that.

Facts.

Not theatrical language.

Then the judge asked Dean:

“Why did you continue after your wife began asking about the money?”

Dean looked toward his attorney.

Then answered:

“Because if I told her everything, she would have stopped it.”

There.

The whole case in one sentence.

Not confusion.

Not marital misunderstanding.

He knew consent would be withheld.

So he removed the chance to give it.
