Chapter 9 - THE PRIVATE COMMITMENT
Richard’s first plan was not murder.
It was discrediting.
He told Evelyn:
“You’re obsessed.”
She answered:
“I’m careful.”
“You haven’t slept.”
“I’m working.”
“You think everyone is conspiring.”
“No. I think specific people are making specific decisions.”
Richard contacted Ashcroft’s medical director.
Said Evelyn was:
paranoid,
sleep-deprived,
fixated,
emotionally unstable.
The medical director refused to admit her based only on a husband’s report.
Richard tried another route.
After a severe argument, Evelyn took a prescribed sleeping pill.
Richard called emergency services and described her as incoherent and unsafe.
She woke in a hospital emergency department.
A psychiatric evaluation was requested.
Evelyn was furious.
But anger is not incapacity.
The evaluating clinician did not find clear grounds for involuntary commitment.
Richard was told to take her home.
The emergency-department evaluation became another important record.
Evelyn was angry.
Sleep-deprived.
Distrustful of Richard.
But she was oriented.
Knew date.
Location.
Reason for conflict.
Denied suicidal intent.
Explained the Ashcroft dispute coherently.
The psychiatrist documented:
No clear evidence at this time of psychosis, mania, or imminent danger requiring involuntary psychiatric hospitalization.
Richard later called that evaluation:
“superficial.”
Maybe every evaluation is limited by time.
But it was still evidence.
And more importantly, it was the only contemporaneous independent psychiatric assessment before Ashcroft took her inside.
Richard told transport staff Evelyn had agreed to rest at Ashcroft because he believed if she got home, she would immediately contact regulators.
Transport staff asked whether she was voluntary.
Richard said:
“Yes, just exhausted.”
The paperwork they received did not contain a formal admission order.
That gap should have stopped the process.
Instead everyone assumed someone upstream had handled it.
Emergency department.
Transport.
Ashcroft intake.
Each relied on the previous handoff.
No single person asked the simplest question strongly enough:
Did Evelyn agree?
He did not.
He arranged transport to Ashcroft for “voluntary rest.”
Evelyn says she never agreed.
