Chapter 6 - THE CUSTODY PETITION THAT WAS ALREADY DRAFTED

The lawyer’s name was Simone Park.

She read the messages and asked one question first.

“Has Melissa filed anything?”

“No,” Daniel said.

“Has she threatened to?”

“No.”

“Has she requested schedule changes in writing?”

Daniel showed her.

Three requests over four months.

More school nights with Melissa.

Reduced exchanges.

A request that Jason’s gaming computer be allowed at Melissa’s house permanently because “Rachel restricts access unpredictably.”

Simone looked up.

“Interesting.”

Rachel asked:

“Why?”

“She’s documenting control over property and access.”

Jason’s computer had been purchased by Rachel.

But he considered it his.

More ambiguity.

Simone continued.

“Teen preference matters. If she can frame this house as emotionally hostile, she may seek modification.”

Daniel’s face hardened.

“Can she win?”

“Maybe.”

Rachel appreciated the honesty.

“Would the group messages hurt her?”

“Yes. But family court is not about punishing a parent for being manipulative. It’s about child welfare.”

“What do we do?”

“Stop creating good evidence for her.”

Rachel almost smiled.

Simone meant:

No revenge shutdowns.

No dramatic expulsions.

No insulting Melissa in front of the children.

No making kids choose.

Document.

Therapy.

Consistent rules.

Separate necessity from privilege.

Repair relationship if possible.

Daniel nodded.

Then Simone asked:

“Who owns the house?”

Rachel answered.

“Me.”

“Who pays for the teens’ major extras?”

“Mostly me.”

“Do they know?”

“Now.”

Simone sighed.

“Blended families and money. Everybody thinks silence is noble until silence gets cross-examined.”

Rachel liked her.

Then Simone said something that shifted the room.

“I want you to consider restoring the teens’ core phone plans now.”

Rachel frowned.

“Why?”

“Because communication with both parents is essential.”

“I agree.”

“Keep entertainment restricted if it’s a consequence. But not family contact.”

Rachel nodded.

Reasonable.

Jason later interpreted the restored phone as weakness.

He texted Melissa immediately.

She caved.

Melissa replied:

Good. Stay calm. Don’t give her anything else.

Jason deleted the message.

The family tablet backup did not.

Rachel saw it that evening.

She did not confront him.

For once.

Instead, she forwarded it to Daniel and Simone.

Then she closed the tablet.

No explosion.

No lecture.
