Chapter 11 - THE TRUST TRIGGER

Nine days passed.

Claire did not return to live with Daniel.

She stayed at Richard’s guesthouse with Lily.

Would that defeat the trust?

Daniel argued yes.

Rachel argued no.

The trust language required:

marriage intact,

residential continuity,

unless absence resulted from coercion, safety concerns, medical necessity, or temporary displacement.

Richard had added that exception after Claire’s first husband? She had none. Better: after observing domestic disputes among relatives.

The trustee had to decide whether Claire’s departure was voluntary separation or safety displacement.

Evidence:

Daniel ordering her out.

Prepared separation document.

Daniel’s emails.

Vanessa’s cooperation.

Crib incident.

Police report.

Independent trustee concluded:

Claire’s departure was not a voluntary abandonment of the family residence.

The child-protection subtrust vested on Lily’s second birthday.

Estimated initial funding:

$11.8 million in diversified family assets.

Not Claire’s personal money.

Lily’s protective trust.

Claire had limited representative rights.

Independent trustee controlled distributions.

Daniel could not access capital for his business.

That was the point.
