Chapter 8 - ETHAN'S BEST ARGUMENT

Ethan hired a lawyer.

His position was not:

Claire imagined everything.

The kitchen incident was too well witnessed.

Instead:

He had been under extreme caregiver stress.

Claire was refusing food.

Refusing medication.

Crying constantly.

Threatening to leave the house against medical advice.

Some of that was true.

Claire had poor appetite.

She sometimes delayed medication because it made her nauseated.

She had cried.

She did want to leave.

Ethan said:

“I was terrified she was going to hurt herself by refusing care.”

His lawyer asked:

“Did a doctor tell you she lacked decision-making capacity?”

“No.”

“Did anyone tell you to physically restrain her?”

“No.”

“Did she ever ask you to manage all medications?”

“At first.”

“For how long?”

Silence.

Caregiving burden was real.

Authority was not unlimited.
