Chapter 5 - THE TRUST THAT NEVER OPENED
There was no Sophie Collins Descendant Trust.
Rachel confirmed.
Instead, nine months after Sophie’s birth, Diane directed company counsel to defer “implementation pending clarification of qualifying descendant definition.”
Clarification from whom?
No court.
No arbitrator.
Just Diane.
She claimed William had verbally intended:
first male grandchild.
But the written agreement said:
first lineal grandchild.
Why delay?
Because Noah already existed.
But Noah was not William’s grandchild.
He was William’s grand-nephew.
Michael was William’s nephew.
Different branch.
Diane’s theory was stranger.
She believed William intended the Collins business to stay in “male hands.”
Since Ethan had a daughter, she wanted Noah’s father Michael positioned as next-generation operating leader and Noah as symbolic family successor.
Except none of that matched the documents.
Ethan said:
“She knew Sophie triggered the trust.”
Rachel answered:
“Yes.”
“Then why didn’t anyone stop her?”
“Because trustees sometimes delay implementation while resolving ambiguity.”
“Was there ambiguity?”
