Chapter 12 - THE TRUSTEE HEARING
The independent trustee petitioned for court instructions.
Question:
Did Daniel and Emily satisfy the five-year marital-continuity condition?
Margaret argued:
Emily left before anniversary.
Violent conflict showed breakdown.
Daniel had already considered separation.
Cohabitation ended.
Rachel argued:
Emily’s departure was coerced by threat of police involvement.
Neither spouse intended genuine separation before the incident.
The temporary-separation document was strategically timed.
The camera was disabled.
Margaret and Ashley coordinated around getting Emily out angry.
Then Richard Carter’s memorandum became central.
A spouse should not become economically invisible after years of contribution.
The judge asked Daniel:
“Did you intend to end the marriage before August twenty-seventh?”
“No.”
“Did Emily?”
“No.”
“Did you plan to ask her to leave temporarily before the anniversary?”
“Yes.”
“Why?”
Daniel hesitated.
“Trust negotiations.”
The judge leaned back.
“So the departure was being sought partly to affect vesting.”
Daniel looked miserable.
“Yes.”
Then:
“Did your mother know?”
“Yes.”
“Ashley?”
“Yes.”
Silence.

The only question left was whether it worked legally.
