Chapter 12 - THE PETITION TO REMOVE DANIEL

Diane filed an emergency petition to remove Daniel as Eli’s guardian.

She accused him of exposing the child to media, pressuring him to identify Carol as Claire, and destabilizing the only family he knew. Dr. Porter supported residential treatment.

The petition was not frivolous merely because Diane was compromised. Eli had been interviewed repeatedly and surrounded by frightened adults. The court appointed a separate attorney and restricted every party from discussing litigation with him.

Daniel complied. Hannah violated the order during a supervised visit.

“If you tell them Grandma locked you up, they’ll take me away,” she whispered.

The supervisor ended the visit and reported it.

Hannah said panic drove the comment. The judge suspended contact pending evaluation but did not terminate her relationship permanently.

Diane’s attorneys then produced footage showing Carol attacking a nurse at the private facility. They argued public identification would expose Daniel and Eli to danger.

The full medical report revealed the nurse attempted medication after Carol refused. She knocked away the syringe and ran. No one was injured.

Selective video made resistance look like violence.

Rebecca obtained a protective order preventing Diane from controlling any narrative or decision on Carol’s behalf. An independent guardian, Elena Ruiz, took temporary authority.

Elena’s first task was finding the missing woman.

Her second was determining whether Carol wanted contact with Daniel or Eli at all.
